Terms of Service

Welcome to 3D Printed Busts (the “Site”). These Terms of Service (the “Terms”) govern your use of our website, services, and the purchase of custom 3D printed busts. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you must not use the Site.

1. Use of the Site

  • Eligibility: You must be at least 18 years old to use this Site or place an order. By using the Site, you confirm that you have the legal authority to enter into this agreement.
  • Personal & Non-Commercial Use: The Site is for personal, non-commercial use. You may not use our services to resell products or for any unlawful activity.
  • Modifications to the Site: We may update, modify, or discontinue portions of the Site at any time without notice.

2. Ordering & Customization

  • Made-to-Order Policy: All busts are custom-made based on user-provided videos. Once production begins, orders cannot be changed or canceled.
  • User Responsibility: You are responsible for ensuring that the video you upload follows our Video Submission Guidelines and meets quality requirements.
  • Order Confirmation: After placing an order, you will receive an email confirmation with a unique upload link to submit your video.
  • Order Completion: Orders will only be processed once the necessary video files are submitted. Failure to upload a video within the given timeframe may result in order cancellation without a refund.

3. Pricing & Payment

  • Pricing: Prices are listed on our Site and are subject to change at any time. The final price at checkout is the price you agree to pay.
  • Shipping Fees: A flat $8 shipping fee applies to all orders.
  • Taxes: Sales tax may be applied based on your shipping location.
  • Payment Processing: We use third-party payment processors (e.g., Stripe) to handle transactions securely. We do not store credit card details.

4. Video Submission Guidelines

  • File Types & Sizes: We accept MP4, MOV, AVI, MKV, and WebM formats. Videos must be between 50MB and 450MB.
  • Multiple Videos: If you want multiple busts of different people or poses, you must upload a separate video for each. If all busts are of the same person and pose, only one video is required.
  • Upload Deadline: Videos must be uploaded within 3 weeks after purchase.
  • Prohibited Content: Do not upload videos that contain illegal, offensive, or copyrighted material. We reserve the right to reject inappropriate content.

5. Refund & Replacement Policy

  • No Refunds on Custom Orders: Because all busts are custom-made, we do not offer refunds once production has begun.
  • Defective or Incorrect Items: If your bust arrives damaged or does not match your order details, contact us within 7 days of receiving it, and we will assess whether a replacement is warranted.
  • Lost or Stolen Packages: We are not responsible for lost or stolen packages once they are marked as delivered. Please contact the shipping provider for assistance.

6. Shipping Policy

  • Domestic Shipping Only: We currently ship only within the United States.
  • Shipping Method: Orders are shipped via USPS Ground Advantage or UPS Ground, depending on the best option for your location.
  • Delivery Time: Most orders arrive within 3-7 business days after processing.

7. Intellectual Property

  • Ownership: We own all content on this Site, including images, branding, and designs. You may not copy, distribute, or modify any content without written permission.
  • Your Video Rights: You retain ownership of your uploaded videos, but by submitting them, you grant us a limited license to use them for the sole purpose of creating your custom bust.
  • Marketing Use: We will not use your video or likeness for marketing purposes without your explicit consent.

8. Limitation of Liability

  • No Guarantees: We do our best to produce high-quality busts, but due to the nature of 3D printing, minor imperfections may occur.
  • No Consequential Damages: We are not liable for any indirect, incidental, or consequential damages arising from your use of our Site or products.
  • Maximum Liability: Our total liability for any claim will not exceed the amount paid for the order in question.

9. Privacy & Data Security

  • Data Collection: We collect personal information, such as your email and shipping details, only for order fulfillment purposes.
  • Third-Party Services: Payments are processed by third parties (e.g., Stripe). We do not store payment information.
  • Video Security: Uploaded videos are stored securely and only used to process your order. They are deleted from our system 7 days after order completion.

10. Force Majeure

We are not liable for any delay or failure in performance due to events beyond our control, including but not limited to natural disasters, acts of war, government regulations, labor strikes, supply chain disruptions, power failures, or pandemics. In such cases, we will make reasonable efforts to resume operations as soon as possible.

11. Changes to These Terms

We may update these Terms from time to time. Any significant changes will be posted on our Site. Your continued use of our Site after changes take effect constitutes acceptance of the new Terms.
